1. Acceptance of Terms

By accessing or using Toklytics ("Service"), including our website at toklytics.app and our Chrome browser extension, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Toklytics provides TikTok analytics tools including:

  • A free Chrome browser extension that displays analytics overlays on TikTok profiles
  • A web-based dashboard for searching and analyzing TikTok creator data
  • Data export functionality
  • Crowdsourced data aggregation from extension users

3. User Accounts

To access certain features of the Service, you must create an account using Google OAuth. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Token System and Payments

The Service uses a token-based system for accessing certain features:

  • Free users receive 10 tokens per day
  • Paid plans provide additional daily tokens
  • Tokens reset daily at midnight UTC and do not roll over
  • Subscriptions are billed monthly through Stripe
  • You may cancel your subscription at any time; access continues until the end of the billing period

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to reverse engineer, decompile, or disassemble any part of the Service
  • Use automated systems (bots, scrapers) to access the Service beyond the provided extension
  • Resell, redistribute, or commercially exploit data obtained from the Service without permission
  • Interfere with or disrupt the Service or servers connected to the Service
  • Harass, abuse, or harm other users or TikTok creators using data from the Service
  • Violate TikTok's Terms of Service using our tools

6. Chrome Extension

The Toklytics Chrome extension operates by analyzing publicly available data displayed on TikTok profile pages. By using the extension:

  • You consent to anonymous contribution of aggregated, non-personal analytics data to our shared database
  • You understand the extension only accesses data on TikTok.com domains
  • You may uninstall the extension at any time

7. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Toklytics and is protected by international copyright, trademark, and other intellectual property laws. TikTok and all related marks are trademarks of ByteDance Ltd. Toklytics is not affiliated with, endorsed by, or sponsored by TikTok or ByteDance.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, available at toklytics.app/privacy. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO WARRANTIES ABOUT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY DATA PROVIDED THROUGH THE SERVICE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOKLYTICS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

11. Indemnification

You agree to indemnify and hold harmless Toklytics and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the Service or violation of these Terms.

12. Modifications to Service and Terms

We reserve the right to modify or discontinue the Service at any time without notice. We may also update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
